General terms and conditions

(as per 30 September 2021)

The following terms and conditions apply for membership in the fitness centre Lifestyle by Fornebuporten (LBF) manged by Lily Akerkvartalet AS (LA):

1 General

These terms and conditions are an integrated part of the LBF membership contract (Contract) entered into between the person named in the contract (Member) and LA.

2 About the Membership

Training at LBF and participation in activities arranged by LBF is at your own risk. LA, its employees, owner(s) or board-members cannot be held accountable for any personal injuries that might occur when using LBFs facilities and/or participating in LBFs activities.

The Member is responsible for his/her health condition and wellbeing and is obliged to make sure that his/her health condition is stable when using LBFs facilities or attending organized activities. The Member is responsible for informing its Personal Trainer (PT) and other LA-staff (if relevant) about health problems or previous injury(s).

LA is not in any way responsible for any damage, theft or other loss of personal belongings that the Member might bring to LBF. The Member is obliged to remove all personal belonging, hereby empty his/her locker, when leaving LBFs facilities. This also applies to personal belongings in LBFs drying room. Any misplaced belonging will be taken care of by LBF and will be thrown away or given to charity after 1 month.

LA cannot guarantee the Member access to any of our training equipment or group activities, or accessibility to our offers and services where the number of participants or access is limited.

LA recommend that the Member consult with one of our PTs before starting training on his/her own.

Cancellation of a PT session, Group training, Massage, or other treatments, must be done at least 24 h before the session starts. When the Member does not show up to a scheduled session or cancels later than 24 h before the session starts, LA has the right to charge the Member for the session. When the Member shows up late for a scheduled session, the length of the session will be reduced accordingly.

Prepaid value cards/packages (PT-sessions, Group training, Massage, or other type of treatment(s)) are non-refundable and expire 12 months after the purchase date.

Memberships are personal and cannot be transferred to others. The Member is responsible for his/her access-card and shall ensure that it does not get misused by others. In case of loss of the Members access card, the Member shall inform LA as soon as possible. The Member will be charged a fee of NOK 99 for a new access card. 

3 Training Fee – Payment

When entering into the Contract, the Member will be charged with a registration fee of NOK 390.

The Member will pay a monthly fee as stated in the Contract (Training Fee). The Training Fee is due at an agreed time; however, this may vary for the first month.

The Member is responsible for payment of the Training Fee before the due date, therefore it is the Members duty to enter a necessary agreement with his/her bank for automatic debiting of the Training Fee, unless the Member chooses to pay the Training Fee for the whole binding period when entering into the Contract.

If the Training Fee and any other fees have not been paid at the due date, LA will send a debt collection notice with a new payment deadline. If it is not paid within the new payment deadline, the invoice claim will be made in compliance with the debt collection act.

If the Member fails to pay, LA has the right to cancel the Contract and keep the Member out until the payment(s) are made. If the Member has not paid 2 months after the due date, this is considered a material breach and LA has the right to terminate the Contract immediately.

After the binding period has expired, LA has the right the change/regulate the Training Fee after 3 months prior to notice.

If the Contract is entered into under special campaign terms, the Contract and the Training Fee will be adjusted to any current normal terms after the binding period has expired.

4 Opening Hours

LBFs opening hours are Monday – Thursday: 08:00 – 20:00, Friday: 08:00 – 18:00, Saturday, 09:00 – 15:00, Sunday: 11:00 – 17:00. LBF is manned during ordinary opening hours.
LBF is entitled to change the opening hours, hereunder reduce or expand the opening hours without staff on site.

LBF will be closed during all holidays, including Holy Saturday, 1st of May, 17th of May and the 24th of December.

LBF will also be closed in certain periods throughout the year when service- and maintenance work is necessary. This type of closing will be informed in advance on LBFs home page and on the digital screens available in the LBF facilities.

5 Cancellation & Changes

The Member cannot terminate the Contract during the binding period. After the binding period has expired (as specified in the contract), the membership will go over to an ongoing contract. The notice period is 3 months, counting from the first of the month after the date the cancellation is received. In case the Member does not wish to remain as a member after the binding period has expired, this has to be informed 3 months before the binding period expires.

The termination is valid when a confirmation is sent by LA to the Member.

LA has the right to terminate the Contract by material breach from the Member. The Member’s duty to fulfil its payment obligations does not get terminated in case LA terminates the Contract because of misconduct of the Member.

LA has the right to change the Training Fee, other fees and these terms and conditions. LA must inform the Member 3 months prior to potential changes.

Doping

LA does not tolerate any use of doping or performance enhancing substances. Usage of such substances is considered a material breach of the Contract and gives LA the right to terminate the Contract immediately. Already paid Training Fee or/and other fees will not be refunded.

6 Privacy and personal information

It is the duty of LA to protect and respect the Members privacy and shall always treat the Members personal information in accordance with the guidelines of our privacy statement which you can find attached to these terms and conditions.

The Member agrees to that LA (and other companies under the same group) collects, stores and processes the Members personal information and other data to administer and manage the membership. Furthermore, the Member accepts that LA (and other companies under the same group) uses electronical communication-tools to communicate with the Member about the relation of the membership, newsletters and marketing of new offers and services.

The Member has the right to view the personal information that LA is storing and can at any time deny the storage of the personal information and the further management of personal information.

LA will store the personal information and data while the membership is active, with an addition of 3 months following termination of the Contract.

Transmission of personal information and data to others than LA (including other companies under the same group) cannot be done without consent from the Member, unless the delivery is required by law, or in relation to payment-dept, insurance-related issues or accounting management.

Responsible for management of the Members personal information is Lily Akerkvartalet AS.

7 Force Majeure

LA is not responsible for hinders or limitations that reduces Lifestyle training services for the Member when the relation is outside of Lifestyles control and Lifestyle cannot foresee or overcome the outcome of the relation.

8 Governing Law and Litigation

The Contract is subject to Norwegian law. In case of deviation between the English and the Norwegian version of the Contract or terms and conditions, the Norwegian version shall prevail.

Disputes between the Member and LA should seek solution in amicability. In case no solution is to be found, the ordinary courts have jurisdiction to settle the disputes or claim that arise out of ot in connection with the Contract.

Privacy Statement:

1 General

Lily Akerkvartalet AS (LA) values privacy and is obliged to protect and respect your privacy. LAs management of private information and data is in conformity with the applicable rules of privacy. This privacy statement, together with LAs Contract, general terms and conditions and other documents that are referred to, is the foundation for the private information and data we are collecting about you according to the consent given in the Contract.

2 Purpose

The purpose for collecting your personal data and other data about you is to administrate and care for your membership in the best way possible and to provide the best experience possible when using our services. The private information consists of name, home address, e-mail address, date of birth, phone number, contact information and activity, and we are using it, amount other things, for:

a.        Administrate appointments, payments and other commitments under the Contract;

b.        To make sure that our web page is adapted to you and the computer/unit you are using;

c.         Inform you about products or services that you stumbled upon or that we think. might be interesting for you;

d.        Make it possible for you to participate in our interactive services when you choose to;

e.        Develop statistics through registration of user data and user patterns in our data system; and

f.         Give notice about eventual changes concerning our products and services.

To secure your personal information and other data about you we have entered a data processor agreement with our data developer system BRP Systems AB.

Your personal information and other data are stored if you are a member with us and if it is expedient. Stored personal information and data will be deleted as late as three months after the Contract is terminated.

3 Voluntariness – the right to insight, correction, and deletion.

It is voluntary to give away your personal information. By entering into the Contract, you agree to let us collect your personal information and other data (training statistics and other) from you. You have the right to view the personal information that we are storing, and you can demand correction or deletion of unnecessary personal information if you wish to do so. Furthermore, you can at any time withdraw the consent for management of your personal information and demand that further management ceases, unless the management of personal information is obliged by law or is necessary for administration of your membership with us.

4 Communication

LA will be able to contact you via e-mail or text message/SMS with important information concerning your membership or our products/services, as well as newsletters and marketing of new products and services. You can also reserve yourself against receiving newsletter and marketing by giving us notice about it. However, you cannot reserve yourself against important information concerning the fitness centre or information that concerns your membership or Contract as long as you have a membership with us.

 5 Usage of Cookies

We are using Cookies to improve, market and protect our services. When using our website, you are agreeing to our usage of cookies. There will be sent out cookies from other websites you are visiting via links on our website, and we are referring to their privacy statement/their website for further information. You can delete our cookies by turning off the function in your web browser.

6 Disclosure of Personal Information

Disclosure of personal information to other than LA (and other companies under the same group) will not happen without an approval from you, unless it is imposed by law, or imposed by a payment collection, insurance demand or accounting purposes. Personal information that is collected is stored if you have a membership with us and three months after termination of the Contract.
